Zefirr Mobility Solutions
This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder and the Digital Personal Data Protection Act, 2023. This electronic record does not require any physical or digital signature.
COMPANY DETAILS
Zefirr Mobility Solutions (“Zefirr”, “Company”, “we”, “us”) is a transportation service provider having its registered office at:
83 SP Mukherjee Road, 04th Floor, Devi Market, Kolkata – 700026, West Bengal, India
SCOPE OF SERVICES
2.1 Zefirr provides chauffeur-driven cab services to customers (“User / You”) through advance bookings made exclusively via phone calls or WhatsApp communication with Zefirr’s authorised representatives.
2.2 No bookings are accepted through any website, mobile application, or automated software platform.
2.3 Zefirr operates as a direct service provider, and all drivers are salaried employees of the Company.
ACCEPTANCE OF TERMS
By placing a booking through phone or WhatsApp, using Zefirr’s services, or travelling in a Zefirr vehicle, you confirm that you have read, understood, and agreed to these Terms & Conditions.
If you do not agree, please do not avail of the services.
ELIGIBILITY
You must be 18 years or older to book or use Zefirr services. Minors must be accompanied by an adult.
BOOKINGS
5.1 Bookings are accepted only through:
- Phone calls to authorised Zefirr numbers
- WhatsApp messages to authorised Zefirr numbers
5.2 Booking confirmation is subject to vehicle and driver availability.
5.3 Zefirr reserves the right to refuse or cancel any booking at its discretion for safety, legal, or operational reasons.
DRIVERS
Drivers engaged by Zefirr Mobility Solutions may include individuals who are employed directly by the company as well as those associated through other permissible arrangements. The nature of a driver’s engagement may vary based on operational needs, regulatory requirements, and service models adopted by Zefirr from time to time. Any such arrangements will continue to uphold the company’s standards of safety, compliance, and service quality
USER OBLIGATIONS
Users shall:
- Provide accurate pickup/drop details
- Behave respectfully with drivers
- Not smoke, drink alcohol, or use illegal substances inside vehicles
- Not damage vehicle interiors
- Comply with all applicable laws
Zefirr reserves the right to terminate the ride without refund in case of misconduct.
PAYMENTS
8.1 Fare details will be communicated at the time of booking and may vary based on:
- Distance
- Duration
- Waiting time
- Tolls, parking, airport charges, or government levies
8.2 Payment modes:
- Cash
- UPI
- Other modes as communicated during booking
8.3 Receipts will be shared digitally on request.
CANCELLATION & NO-SHOW
9.1 Cancellation by User
No cancellation fee will be charged if a confirmed booking is cancelled up to 12 (twelve) hours before the scheduled pickup time.
9.2 Late Cancellation
If a booking is cancelled within 12 (twelve) hours of the scheduled pickup time, 50% of the total fare shall be refunded to the User. The refund will be processed to the original mode of payment.
9.3 No-Show / Unreachable User
If the assigned driver reaches the pickup location and waits for more than 30 (thirty) minutes, and the User is unreachable or does not report for the ride, Zefirr reserves the right to cancel the booking. In such cases, 20% of the total fare shall be refunded to the original mode of payment.
9.4 Refund Processing
All eligible refunds, if applicable, shall be processed to the User’s original payment method within 5–7 business days from the date of cancellation confirmation.
LUGGAGE & BELONGINGS
Users are responsible for their personal belongings. Zefirr may assist on a best-effort basis for lost items but assumes no liability.
PRIVACY & DATA PROTECTION
11.1 Zefirr collects only necessary personal data such as name, phone number, and trip details.
11.2 Data is processed in accordance with:
- Information Technology Act, 2000
- Digital Personal Data Protection Act, 2023
11.3 Data may be retained for legal, billing, safety, and compliance purposes.
LIMITATION OF LIABILITY
12.1 Zefirr shall not be liable for delays caused by traffic, weather, road conditions, strikes, political events, or force majeure events.
12.2 Maximum liability, if any, shall be limited to ₹1,000 or the ride fare paid, whichever is lower, subject to applicable law.
FORCE MAJEURE
Zefirr shall not be liable for failure or delay due to events beyond reasonable control including natural disasters, strikes, government actions, or technical failures.
WHATSAPP BOOKING DISCLAIMER
14.1 Users may have the option to book rides or interact with Zefirr through WhatsApp or other messaging platforms(“Messaging Services”). By using Messaging Services to book rides, Users acknowledge and agree that:
14.1.1 Third-Party Platforms – WhatsApp or other messaging platforms are third-party services not controlled by Zefirr. Zefirr shall not be responsible for any delays, errors, failures, or miscommunications arising from the use of these platforms.
14.1.2 Terms & Fees Apply – All bookings, modifications, or cancellations made via Messaging Services are subject to the same Terms & Conditions, Company Policies, and applicable fees (including cancellation fees, additional charges, or location fees) as those made through phone bookings.
14.1.3 Booking Confirmation – Zefirr will make reasonable efforts to confirm bookings made via Messaging Services, but Users acknowledge that confirmation depends on message delivery and receipt. Zefirr is not liable for any losses or damages arising from failed or delayed message delivery.
14.1.4 Accurate Information – Users agree to provide accurate, complete, and current information while interacting with Zefirr via Messaging Services. Zefirr shall not be liable for any consequences arising from incorrect or incomplete information provided by the User.
14.1.5 Message Retention – Zefirr may record or retain messages exchanged via Messaging Services for the purposes of customer service, dispute resolution, compliance with applicable laws, and quality assurance.
TERMINATION OF SERVICE
Zefirr reserves the right to refuse service or terminate a ride without refund in case of:
- Safety concerns
- Legal violations
- Abuse of staff
- Non-payment.
GOVERNING LAW & JURISDICTION
16.1 These Terms shall be governed by the laws of India.
16.2 Courts at Kolkata, West Bengal shall have exclusive jurisdiction.
16.3 Any dispute shall first be attempted to be resolved amicably. Failing which, disputes shall be subject to arbitration seated in Kolkata, under the Arbitration & Conciliation Act, 1996.
